Aggressive criminal seizure
It is the expulsion of immovable property without the consent of the owner or with the permission of the owner by another knowingly and intentionally. The crime of aggressive possession is one of the crimes against property and ownership, the subject of which is immovable property belonging to another. In Article 690 of the Islamic Penal Code, the legislator predicts the crime of aggressive occupation and states that if the three elements of the crime come together, the perpetrator will be sentenced to one month to one year in prison.
The elements of the crime of aggressive occupation are:
First) Legal element of the crime of aggressive occupation: Articles 690 to 693 of the Islamic Penal Code
Second) Material element of the crime of aggressive possession: customary and material possession of immovable property belonging to another with the intention of using it to his advantage.
Third) Spiritual element of the crime of aggressive possession: the intention to harm others is not the specific intent of this crime.
